The Chattahoochee Riverkeeper filed a lawsuit on May 22 against the owner and developer of Aspire at Old Guard apartments for allegedly violating the Clean Water Act.

According to officials, SCorUSA, LLC, founded by Steven Corbett, and Apsire at Old Guard, LLC, did not take appropriate measures to protect nearby waterways from muddy stormwater runoff while constructing the apartment complex.

Officials say this resulted in worsening pollution conditions in neighboring streams such as a tributary to Heiferhorn Creek, which ultimately flowed into Lake Oliver and the Chattahoochee River.

“In almost twenty years with CRK, this development is among the worst that I have ever seen. The failure to implement and maintain basic pollution controls has destroyed the neighboring creeks and aquatic life downstream. Given the gravity of these violations and the defendants’ refusal to work collaboratively on a solution, CRK is moving forward with our lawsuit.”
